A suit against fossil fuel companies for allegedly damaging coastal wetlands belongs in state court, and a lower court’s ruling that it didn’t misunderstood Louisiana law, New Orleans told the Fifth Circuit.
The district court’s refusal to remand the case, based on its interpretation of the Louisiana State and Local Coastal Resources Management Act, is at odds with the law’s purpose of “protecting the coastal zone and supporting development that mitigates, rather than exacerbates, the impact of climate-related disasters,” the city told the US Court of Appeals for the Fifth Circuit on Thursday.
