A federal district court in Oklahoma granted Reliance Standard Life Insurance Company’s motion to dismiss a Provident Funding Associates LP employee’s ERISA action challenging the termination of long-term disability benefits. According to the court, attorneys’ fees relating to a pre-litigation administrative appeal aren’t compensable under ERISA, and RSL’s deduction of social security disability benefits from the employee’s monthly disability payments isn’t a breach of fiduciary duty.
