Texas Justices Side With Landfill Owner in Property Tax Suit (1)

The Texas Supreme Court held Friday that a landfill owner’s $2.8 million property tax valuation can’t be contested on grounds independent from the original protest or lower tribunal’s decision.

Texas law restricts state trial courts from reviewing assessment appeals on grounds not brought up in the original complaint and assessment review board’s holding, the court said. This limitation however, is not jurisdictional, but procedural, Justice Jane N. Bland said.
