Republican AGs Challenge Title IX Rule Clarifying LGBTQ Rights

Five Republican state attorneys general filed challenges Monday to the Biden administration’s new Title IX rule that aims to strengthen protections for transgender students.

The rule, which will become effective on Aug. 1, “prohibits discrimination and harassment based on sexual orientation, gender identity, and sex characteristics in federally funded education programs, applying the reasoning of the Supreme Court’s ruling in Bostock v. Clayton County,” the Department of Education said in a statement. The Supreme Court in Bostock ruled that Title VII bars workplace discrimination based on sexual orientation, in an opinion by Justice Neil Gorsuch.
