A new federal rule intended to protect miners from inhaling silica dust in toxic quantities is being challenged in a federal appeals court by several mine operator organizations.
The US Mine Safety and Health Administration rule requires mines to cut respirable silica levels by 50%. The nation’s 1,100 coal mines have until April 2025 to comply, while the 11,000 underground and surface non-coal mines have until April 2026.
In a written statement Tuesday, National Stone, Sand, and Gravel Association President Michael Johnson summarized the employers’ objections.
