Fifth Cir. Judges Mostly Mum on Obamacare Preventive Care Rule

Three federal appeals judges kept their thoughts to themselves while hearing arguments Monday in a case that threatens to strip no-cost preventive health care services from millions of Americans.

The decision by the US Court of Appeals for the Fifth Circuit over recommendations about what preventive services employee health plans must pay for in full will have tremendous consequences.

These preventive services “are critical” to saving the lives of millions of Americans, Department of Justice attorney Daniel Aguilar, arguing on Becerra’s behalf, told Judges Don. R. Willett, Cory T. Wilson, and Irma Carrillo Ramirez.
