A Nevada minor can proceed a medical malpractice lawsuit after the state’s top court ruled that emergency orders issued by the governor during the Covid-19 pandemic extended the time for filing her claims.
Former governor Steve Sisolak (D) issued emergency directives in 2020 that, by their plain language, interrupted time limits for bringing “any” suit between April 1 and August 1, 2020, the Nevada Supreme Court said Thursday. His “broad, all-encompassing language” supported an interpretation that the orders applied to suits other than those in which the statute of limitations expired during that period, it said.
