ANALYSIS: Patchwork of State Laws for Child Online Privacy Grows

New York on Thursday became the latest state to join a growing number of jurisdictions taking child privacy and online safety into their own hands in the absence of meaningful federal regulation. These laws are continuing to proliferate in the US—as are challenges to them. The emerging state legislative landscape is surprisingly diverse, and shows the different approaches that states have adopted to address legal challenges.

Despite a surprising setback in September, when a federal district court in California blocked the enforcement of California’s flagship child online service design code law, states aren’t ceding the fight.
