Agriculture Services Provider CGB to Face BIPA Suit, Judge Says

Agricultural services provider CGB Enterprises Inc.'s bid to escape a proposed class action alleging its use of timekeeping technology violates the Illinois Biometric Information Privacy Act was shot down by a federal judge.

Judge Sue E. Myerscough of the US District Court for the Central District of Illinois on Thursday denied the company’s motion to dismiss claims that its biometric data collection practices violated BIPA.

The judge rejected CGB’s arguments that named plaintiff Kyle Hayes failed to sufficiently allege that the company “possessed,” “collected,” and “disseminated” plaintiffs’ biometric data, according to the order.
